Terms of Service.

1. Who We Are

Markhouse ("we," "us," "our") supplies branded corporate merchandise — onboarding kits, apparel, drinkware, bags, and corporate gifting — sourced, branded, and delivered as a finished order. These Terms apply to any order placed with us via our website, email, or direct communication.

2. Quotes & Orders

• All pricing is quoted per order based on volume, customization, and delivery timeline. A quote is valid for 14 days unless otherwise stated.
• An order is confirmed once you approve a quote and pay the advance (see Section 3). Production does not begin before both are received.
• Order details (quantities, specifications, artwork) are confirmed in writing (email is sufficient) before production.

3. Payment

• 50% advance payment is due upon order confirmation, before production begins.
• The remaining balance is due within the timeframe stated on your invoice, typically upon delivery or within 15 days.
• All prices are exclusive of applicable GST, charged additionally at prevailing rates.
• Delayed payment beyond agreed terms may attract a reasonable delay charge, at our discretion, communicated in advance.

4. Artwork & Branding

• You are responsible for providing accurate logo files, brand colors, and specifications.
• We will share a digital proof before production begins on any new design. Production will not start without your written (including email) approval of that proof.
• We are not liable for errors in a design that was explicitly approved by you before production.

5. Turnaround & Delivery

• Standard turnaround is 5–7 working days from artwork approval, unless otherwise agreed. Rush delivery is available on request, subject to a surcharge and supplier availability.
• We are not liable for delays caused by circumstances outside our reasonable control, including but not limited to supplier delays, courier disruptions, natural events, or government restrictions. We will communicate any known delay as soon as possible.
• Delivery is PAN India via third-party courier partners. Once dispatched, delivery timelines are subject to the courier's own service standards.

6. Quality & Defects

• Please inspect delivered goods within 3 working days of receipt and report any defects, damage, or branding errors in writing.
• Valid defects will be resolved by reprint, replacement, or partial refund at our discretion, within a reasonable timeframe.
• Claims raised after 3 working days will be reviewed case by case and are not guaranteed resolution.

7. Cancellations & Refunds

• Orders may be cancelled before production begins for a full refund of any advance paid.
• Once production has started, the advance payment is non-refundable, as it covers supplier and production costs already committed on your behalf.
• Custom-branded goods cannot be resold to another buyer, which is why cancellation after production start is not eligible for a refund.

8. Intellectual Property

• You retain ownership of your logo, brand assets, and any content you provide.
• By submitting artwork, you confirm you have the right to use it and to have it applied to the ordered goods. You agree to indemnify us against any third-party claim arising from artwork you provided.
• We may photograph finished, unbranded-to-you-specifically sample work for our own portfolio/marketing use, unless you request otherwise in writing.

9. Limitation of Liability

Our liability for any order is limited to the value of that order. We are not liable for indirect, incidental, or consequential losses (such as lost business or reputational harm) arising from a delayed or defective order, beyond the remedies described in Section 6.

10. Confidentiality

Information shared with us for order fulfilment (including any personal data required for onboarding-kit delivery) is used solely for that purpose and is not shared with third parties beyond suppliers and couriers strictly necessary for delivery. See our Privacy Policy for further detail.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after an update constitutes acceptance of the revised Terms. Material changes will be reflected with an updated "Last updated" date above.

12. Governing Law

These Terms are governed by the laws of India. Any disputes are subject to the jurisdiction of courts in India.
